This Legal Notice sets out the rules regarding the use of the Polaya website, available at https://polaya.pl, as well as the nature of the information and materials published on the Website.

Information published on the Website, including content relating to beauty, skincare, lifestyle, nutrition, diet, health and wellbeing, is generally intended to be informational, educational and general in nature.

Materials published on the Website, including articles, guides, e-books, PDF files, product descriptions, recommendations and other Digital Content, do not constitute individual medical, dietary, cosmetological, pharmaceutical, psychological or other specialist advice tailored to the individual circumstances of the user, unless expressly stated otherwise.

As part of its business activities, the Store may offer, among other things, e-books, guides, PDF materials, digital publications, compilations, instructions, educational materials and other Digital Content.

The scope and nature of a specific Digital Content product are determined by its description presented in the Store before purchase.

Digital materials are prepared for the purpose of providing specific information, knowledge or recommendations and generally do not constitute an individual consultation service, unless the offer for a particular product expressly states otherwise.

Purchase of Digital Content does not constitute the establishment of a medical treatment relationship, medical care, individual dietary consultation, psychological consultation or any other professional advisory relationship, unless the specific product is expressly described as such a service.

The Customer should read the product description before making a purchase.

§ 4. Information Concerning Health, Diet and Skincare

Information concerning health, nutrition, diet, supplementation, skincare, haircare, appearance, lifestyle and wellbeing may depend on the individual characteristics and circumstances of a particular person.

Polaya does not guarantee that applying a particular piece of information, recommendation, skincare method, dietary approach or other solution presented on the Website will produce an identical result for every person.

The results of using products, skincare methods, dietary approaches or other recommendations may vary depending on the individual circumstances of the user.

In the event of concerning symptoms, an allergic reaction, deterioration of health or other adverse symptoms, the use of the relevant solution should be discontinued where appropriate and an appropriate specialist should be consulted.

Information contained on the Website should not be used for independently diagnosing diseases or as a substitute for professional diagnosis or treatment.

§ 5. Accuracy and Currentness of Information

Polaya makes reasonable efforts to ensure that information published on the Website is presented accurately and remains up to date.

Due to the nature of the information and the possibility of changes in legislation, recommendations, scientific knowledge, product availability or other circumstances, it cannot be guaranteed that every piece of information will remain current at all times.

Information concerning products, their properties, composition, intended use or method of use should always also be verified against the current product packaging, label, leaflet or other manufacturer materials, where applicable.

In the event of discrepancies between information presented on the Website and current information provided by the manufacturer concerning a specific product, the current information appearing on the product or in the manufacturer's documentation should be taken into account, subject to the Seller's obligations under applicable law.

Polaya may update, amend, supplement or remove content published on the Website.

§ 6. Copyright and Intellectual Property

Content available on the Website, in particular texts, photographs, graphics, logos, designations, Digital Content, website layout, graphic elements, e-books, guides, PDF files and other materials, may constitute works protected by copyright or other intellectual property rights.

Unless expressly stated otherwise, the rights to materials published by Polaya belong to Polaya sp. z o.o. or to other authorized entities.

Use of materials available on the Website is permitted only to the extent resulting from applicable law and granted permissions.

Without the prior consent of the authorized entity, it is not permitted, in particular, to copy, distribute, publicly make available, modify, resell or use materials in any manner exceeding the permitted use under applicable law.

Purchase of Digital Content does not constitute a transfer of economic copyright to the purchased material to the Customer, unless expressly stated otherwise.

A purchased e-book, PDF file or other digital material is intended for use by the Customer within the scope specified in the Agreement and applicable law.

§ 7. Trademarks and Designations

The name Polaya, its logo, product designations and other elements identifying the brand may constitute trademarks or other protected designations.

Nothing in this Legal Notice constitutes a license to use trademarks or other designations belonging to Polaya or third parties.

Use of trademarks or designations beyond the scope permitted by law requires the consent of the relevant rights holder.

§ 8. Liability for Content

Polaya is responsible for content and services provided through the Website to the extent required by mandatory provisions of applicable law.

This Legal Notice does not exclude or limit liability that cannot be excluded or limited under applicable law.

Information presented on the Website is general in nature and should not be treated as a guarantee of achieving a specific result by every user.

To the extent permitted by applicable law, Polaya shall not be liable for individual decisions made by users on the basis of information of a general nature.

The above provision does not limit consumer rights or Polaya's liability arising from mandatory provisions of applicable law.

Polaya may take action in relation to content that violates applicable law, the Terms and Conditions or the rights of third parties, to the extent permitted or required by law.

Polaya makes reasonable efforts to ensure that the Website operates properly and securely.

Due to the nature of internet services, however, uninterrupted availability of the Website, the absence of all possible technical errors or the complete elimination of the risk of technical problems cannot be guaranteed.

Polaya may temporarily restrict access to the Website, in particular in connection with technical work, maintenance, updates or circumstances beyond Polaya's control.

Technical restrictions do not affect consumer rights arising from concluded Agreements where the obligation to perform them results from applicable law.

§ 12. Consumer Rights

Nothing in this Legal Notice is intended to exclude, limit or modify the rights of Consumers or Entrepreneurs with consumer rights arising from mandatory provisions of applicable law.

In particular, this Legal Notice does not limit the statutory right of withdrawal from a contract, rights arising from the lack of conformity of Goods or Digital Content with the Agreement, or other rights available to Consumers under applicable law.

§ 13. Personal Data Protection

The rules concerning the processing of users' and Customers' personal data are set out in the Privacy Policy and Cookies document.

Information concerning the use of cookies, analytics, advertising and marketing tools is available in the Privacy Policy and Cookies and in the relevant consent management mechanisms used on the Website.

The user should review the Privacy Policy and Cookies before using the Website's functionalities where required by applicable law.
